<p>How The Computer Criminals Control Information &#8211; Types Of Computer Crime</p>
<p>As computer-related crimes become more prevalent, understanding the types of computer-related crimes provides law enforcement an insight for investigative strategies.</p>
<p>The first insight is knowing the types of<span id="more-84"></span> computer crimes.</p>
<p>Computer as the Target</p>
<p>This computer crime includes theft of intellectual property. The offender accesses the operating program under the guise of the system&#8217;s manager. The intruder accesses the contents of computer files in the system through the trap door that permits access to systems should there be a human or technological problem.</p>
<p>Here, the offender uses the computer to obtain information or to damage operating programs while committing the following computer crimes:</p>
<p> * Theft of marketing information, like customer lists, pricing data, or marketing plans<br /> * Blackmail based on information gained from computerized files, like the medical information, personal history, or sexual preference<br /> * Sabotage of intellectual property, marketing, pricing, or personnel data<br /> * Sabotage of operating systems and programs with the intent to impede a business or create chaos in a business operations<br /> * Unlawful access to criminal justice and other government records<br /> * Changing a criminal history, modifying want and warrant information<br /> * Creating a driver&#8217;s license, passport, or another document for false identification<br /> * Changing tax records or gaining access to intelligence files<br /> * Techno-vandalism through unauthorized access to damage files or programs<br /> * Techno-trespass violating the owner&#8217;s privacy as in criminal trespass</p>
<p>Computer as the Instrumentality of the Crime</p>
<p>Here, the processes of the computer facilitate the crime.</p>
<p>The computer criminal introduces a new code (programming instructions) to manipulate the computer&#8217;s analytical processes and for converting legitimate computer processes for the following illegitimate purposes:</p>
<p> * Fraudulent use of automated teller machine (ATM) cards and accounts<br /> * Theft of money from accrual, conversion, or transfer accounts, credit card fraud, fraud from computer t<br />

ransactions like the stock transfers, sales, or billings and telecommunications fraud<br /> * Billing charges to other customers through cellular phones<br /> * Once they capture the computerized billing codes, the computer criminals program these codes into other cellular phones simply by hooking up the phone to a personal computer<br /> * Using software originally developed by programmers in other countries they reprogram the signal chip in the cellular phone<br /> * Share the same through underground computer bulletin board services (BBS)</p>
<p>Computer is incidental to other crimes</p>
<p>In this category of computer crime, the computer is not essential for the crime to occur.</p>
<p>In every following case, the systems merely facilitate the offenses:</p>
<p> * Helping the computer crime to occur faster<br /> * Processing of greater amounts of information<br /> * Making the computer crime more difficult to identify and trace<br /> * Unlawful banking transactions and money laundering<br /> * Supporting unlawful activity via BBSs<br /> * Erasing or denying proper access of organized computer crime records or books, and bookmaking involving drug raids, money laundering seizures, and other arrests in encrypt the data or design<br /> * Allowing computer criminals to destroy the storage media, such as disks, to eliminate evidence of their illegal activities<br /> * Letting child pornographers exchange information through BBSs</p>
<p>These computer crimes require unique data recovery techniques in order to gain access to the evidence.</p>
<p>Computer Crimes Associated With the Prevalence of Computers</p>
<p>The presence of computers, and microcomputers, generates sinister mutations of the traditional crimes like the software piracy/counterfeiting, copyright violation of computer programs, counterfeit equipment, black market computer equipment and programs, and theft of technological equipment.</p>
<p> * Violation of copyright restrictions of commercial software can result in the staggering loss to businesses<br /> * Hackers break into computers with the help of the software illegally written and sold<br /> * Successful computer programs, like the word processing, spreadsheets, and databases are duplicated, packaged, and sold illegally on a large scale<br /> * Just like the pirated audio and video tapes, counterfeit computers and peripherals (items such as modems and hard disks) are also manufactured and sold under the guise of originals</p>
<p>Legal Issues Of Computer Crimes</p>
<p>Some States have enacted laws specifically directed toward computer crimes, while other States rely fundamentally on the common law as it applies to current and emerging technology. The elements of a computer-related offense must be established for successful prosecution.</p>
<p> * The physical act of a computer crime, actus reus, may be demonstrated best by an electronic impulse<br /> * It is difficult to define and track<br /> * A computer crime can occur in 3 milliseconds using a program code that tells the software to erase itself after the computer executes the action eliminating the evidentiary trail<br /> * Causation relates to the self-destruction of computer programs that facilitate computer crimes and an investigator can not show causation if the offender erases the executing instructions<br /> * The electronic data interchange (EDI) and its networks complicate the legal elements by making computer crimes more difficult for law enforcement to specify, document, and materially link the crime to an individual<br /> * The EDI connects parties via computer for contract negotiations, sales, collections, and other business transactions<br /> * The computer becomes the vault, with the EDI serving as the key to its contents<br /> * The ability to access data in the computer must be relatively easy in order to maximize business efficiency<br /> * Security controls must be introduced in order to protect the business&#8217; &#8220;crown jewels&#8221;<br /> * Maximum security and easy accessibility are<br />

<p>Intellectual property consists of concepts, ideas, planning documents, designs, formulas, and other information-based materials intended for products or services that have some commercial value or represent original thoughts or theses. Crimes associated with intellectual property focus primarily on theft when the product has commercial value, as opposed to basic research or research for private use.</p>
<p>Intellectual Property:</p>
<p> * Involves formulas, processes, components, structure, characteristics, and applications of new technologies and covers such areas as fiber optics, computer chip designs and conductivity, and telecommunications equipment, protocols, and technologies<br /> * Associated with the marketing and production of new technologies<br /> * Pricing information, marketing targets, product release dates, and production timetables</p>
<p>Computer Crimes by Malfeasance</p>
<p>The concept of computer crimes by malfeasance means that computer-related behavior stretches the bounds of legality and may be viewed as only technically wrong.</p>

<p>Visualize Your Tax Delinquent Property Using Plat Maps</p>
<p>Plat maps are important in tax lien property investment, especially when no clear address has been given to the property. As we all know they are illustrations that help us locate certain monuments in the area. This gives evidence<span id="more-82"></span> of familiar landmarks. This is a way to identify if the property has road access or other rights of way. Knowing that kind of information can help you determine if that property you are looking to invest in has access to a public road, which is a legal requirement imposed by the government.</p>
<p>Plat maps visually provide you with important information pertaining to the property such as: property dimensions, shape and position. Most plat maps also point out landmarks. (like rivers, train tracks, roads, trails, and sometimes elevation). You can use a plat map to locate a street address or find the GPS coordinates if a parcel has none on record.</p>
<p>To obtain a plat map you will need first the APN (Assessors Parcel Number) or the property. This number is the county&#8217;s unique identifier for the property. Once you have this number check you see if your county has a website. Most counties allow you to search property records online. If your county does not offer their records online, then you can physically go to the Assessor&#8217;s office in your county that you have chosen to invest in and look up documents from there. But for now, let&#8217;s assume you can use the internet as your research tool, which I personally think is an absolute necessity in this business. You are well on your way to finding your property. Using the counties plat map search tool, type in your properties APN and pull up the plat map. This is usually accessed in a .pdf or .tiff file format.</p>
<p>The plat map that you pull will show you a bunch of parcels with identifying numbers or letters. Each parcel may have the dimensions printed beside them and may contain outlines of roads, landmarks, rivers, trails or tracks. Each county is different in the way they identify a property on the plat map, so check with your county on this, but as a general thumb rule most counties use the last digits of the APN number to identify the parcel. For instance if an APN number reads 380-477-058, then the on the plat map the property may be marked with a circled 058 number. Also look at your properties legal description if the legal reads &#8220;Lot 2 in Block A of the<br />
1000<br />
San Fernando River Subdivision&#8221; then you would need to pull the plat map for block A of the San Fernando Subdivision and look for the lot that has 2 printed on it. </p>
<p>Plat maps are official recorded documents that give you a visualization of the lots in any given area and they are invaluable when doing your due diligence before an investment purchase. For instance, you will be able to determine if you are investing in a one acre lot surrounded by large 40 and 80 acre parcels or a one acre lot next to one to two acre lots. Another great reason to view the plat map is that the plat map is that it gives you a quick overall view of the area. Properties zoned for residential use next to a train track may not be what you what to invest in and will probably significantly reduce your chances to sell the property later on. By taking a quick look at the properties plat map you should be able to weed out a lot of the parcels that you don&#8217;t want to buy. My favorite example though on why you should look at the plat map is that sometimes, although very rarely, you will come across parcels that are 1 acre however they are only 10 feet wide and 4356 feet long. This type of parcel is deceiving and if such a parcel is for sale in a great neighborhood for a very low price you maybe tempted to react in haste. But remember, Always view the plat map&#8230; in the above case you will be glad to have caught this junk property before you purchased it.</p>

In 2004, Republicans demanded fuller disclosure about the considerable fortune of Teresa Heinz Kerry, wife of Democratic presidential candidate John Kerry. </p>
<p>
Now, the GOP is reaping what it sowed. </p>
<p>
Having established a recent precedent for increased scrutiny of spousal finances, the party now finds its own presumptive nominee, John McCain, under an unwanted spotlight over the fortune of his wife, Cindy. </p>
<p>
Already, Democrats have blasted Cindy McCain&rsquo;s less-than-full financial disclosure, asserting that it calls into question John McCain&rsquo;s commitment to transparency and suggests that he may be &ldquo;hiding&rdquo; information about how his efforts in Congress benefited his family. </p>
<p>
Worse though, the burgeoning focus on Cindy McCain&rsquo;s finances could attract attention to an aspect of the Arizona senator&rsquo;s family life that is unlikely to be advantageous to him on the campaign trail: the affluent lifestyle and free-spending habits of the McCain clan. </p>
<p>
Cindy McCain and the McCain children are the beneficiaries of a beer distributing fortune amassed by her parents and estimated to be worth $100 million or more. Though the McCains maintain separate finances, Cindy McCain&rsquo;s family fortune has boosted her husband&rsquo;s political career at critical junctures, helping to fund his inaugural 1982 run for Congress and helping to subsidize his current presidential campaign when it all but went broke last year.</p>
<p>In recent years, a Politico analysis found, the McCain family appears to have tapped its fortune liberally. </p>
<p>
While Cindy McCain, her dependent children and the trusts and companies they control made as much as $29 million&#160;&mdash; and likely substantially more&#160;&mdash; from her family&rsquo;s business interests from 2004 through last year, data from the Internal Revenue Service, the U.S. Senate, the U.S. Office of Government Ethics and the Center for Responsive Politics also reveals that they spent $11 million purchasing five condominiums for the family, hired additional household help and racked up progressively larger credit card bills almost every year. </p>
<p>
Their credit card bills peaked between January 2007 and May 2008, during which time Cindy McCain charged as much as $500,000 in a single month on one American Express card and $250,000 on another, while one of their two dependent children had an AmEx card with a monthly balance as large as $50,000. </p>
<p>
A campaign aide who did not want to be identified discussing the McCains&rsquo; personal finances stressed that the credit card balances are &ldquo;not ongoing debt.&rdquo; </p>
<p>
The aide pointed out that the disclosure forms on which the credit card liabilities were listed ask respondents to indicate ranges for the largest balances owed during the reporting period. </p>
<p>
&ldquo;It has been the McCains&rsquo; practice and procedure, as previously indicated, to pay off the balance of credit cards on a monthly basis, so they do not carry credit card debt,&rdquo; the aide said in a statement. </p>
<p>
The aide did not answer questions about what Cindy McCain or her children purchased with the cards and declined to make either she or her husband available for an interview about their finances or spending habits. </p>
<p>
Cindy McCain released only the first two pages of her 2006 tax return. She received an extension until Oct. 15 to file her 2007 returns, and the aide said &ldquo;she will make the decision whether to release her 2007 return at the appropriate time.&rdquo; </p>
<p>
During the 2004 presidential campaign, Teresa Heinz Kerry, whose fortune was estimated to be worth more than $750 million, eventually released comparably limited information about her finances after repeated demands from Republicans who asserted the public&rsquo;s right to know because they said her finances were intertwined with those of her husband&rsquo;s presidential campaign. The Kerry campaign had benefited from a $6.4 million personal loan John Kerry secured using, as collateral, equity in a Boston townhouse the couple jointly owned. </p>
<p>
Likewise, John McCain&rsquo;s presidential campaign benefited from Cindy McCain&rsquo;s fortune, using a legal loophole to travel the country in a jet owned by her company for cut-rate fares. </p>
<p>
That revelation, combined with recent reports about Cindy McCain&rsquo;s hefty credit card tabs&#160;and nearly $7,000 in unpaid property taxes on a condo owned by a trust she oversees have drawn even closer scrutiny to the McCain family finances. </p>
<p>
While John McCain&rsquo;s campaign spending is a matter of public record, his family&rsquo;s personal spending is not, and for the most part there&rsquo;s only anecdotal information available.</p>
<p>For instance, in the June issue of Vogue magazine, Cindy McCain said she favors suits made by the German designer Escada, which typically retail for around $3,000 a pop. If she becomes first lady, she told Vogue she may switch to an American designer, possibly Carolina Herrera, whose suits are comparably pricey.</p>
<p>
But one area in which Cindy McCain&rsquo;s spending&#160;&mdash; and its impact on her husband&rsquo;s lifestyle&#160;&mdash; can be chronicled is real estate. </p>
<p>Property records show that trusts and corporations controlled by her and her children spent nearly $11 million between the summer of 2004 and February 2008 on three condominiums in Phoenix and a pair outside San Diego. </p>
<p>One of the Phoenix condos, a 6,600-square-foot unit for which Cindy McCain&rsquo;s trust paid $4.7 million in October 2006, became Cindy McCain&rsquo;s primary residence after the trust sold the couple&rsquo;s Phoenix house&#160;for $3.2 million in December 2006. She&#160;had purchased the house years earlier&#160;from her father.</p>
<p>Less than one year later, a corporation controlled by Cindy McCain bought another condo on a lower floor in the same building for $830,000. </p>
<p>And, in between, the corporation plunked down $700,000 for a 1,900-square foot, three-bedroom loft condo for her then-22-year-old daughter Meghan McCain, who was moving back to Phoenix after graduating from New York&rsquo;s Columbia University. </p>
<p>Cindy McCain, through another family corporation, spent about $4.7 million in 2004 and 2008 on two condos in an exclusive building in Coronado, Calif., an affluent San Diego suburb noted for its high percentage of military retirees. </p>
<p>In her recent Vogue interview, conducted from the newer Coronado condo, McCain explained that her husband, a Navy veteran, initially wasn&rsquo;t keen on the idea of a pied-&#224;-terre in Coronado. </p>
<p>&#8220;When I bought the first one, my husband, who is not a beach person, said, &#39;Oh, this is such a waste of money; the kids will never go,&#39;&rdquo; she told Vogue. &ldquo;Then it got to the point where they used it so much I couldn&#39;t get in the place. So I bought another one.&rdquo; </p>
<p>Through her trusts and other corporate entities, Cindy McCain also owns another three properties: a scenic ranch outside Sedona, Ariz., where John McCain has entertained staff, prospective running mates and political reporters; a three-bedroom Arlington, Va., condo that&rsquo;s been John McCain&rsquo;s Washington-area residence since 1993 and the La Jolla, Calif., condo on which the back taxes were due. </p>
<p>The McCains increased their budget for household employees from $184,000 in 2006 to $273,000 in 2007, according to John McCain&rsquo;s tax returns. </p>
<p>The additional cash supports an &ldquo;increase in the number of employees,&rdquo; said the McCain aide, who did not say whether the growing staff stemmed from the addition of new properties to the family&rsquo;s real estate portfolio. </p>
<p>Other than the primary Phoenix residence, the aide said the new condos were &ldquo;purchased for investment and are available for personal use by the McCain family.&rdquo; </p>
<p>The recent growth in the family&rsquo;s credit card bills could stem from furnishing, decorating and moving into the new condos, said Christopher Cordaro, a wealth manager at RegentAtlantic Capital in New Jersey. </p>
<p>After reviewing the McCains&rsquo; taxes and disclosures for Politico, he declared their finances in ship-shape and their spending understandable when &ldquo;put in perspective that the McCains are very wealthy.&rdquo; </p>
<p>&ldquo;You certainly wouldn&rsquo;t see the average person ringing up that large of a monthly balance,&rdquo; he said. &ldquo;But if you&rsquo;re worth $100 million, the amount they&rsquo;re spending is not inordinate. I&rsquo;m sure that at their level, they&rsquo;re putting lots of stuff on their credit card.&rdquo; </p>
<p>Judging by their finances and spending, Cordaro asserted the McCains likely qualified for top-tier charge accounts loaded with benefits. </p>
<p>In addition to the American Express cards&#160;&mdash; which carry no monthly interest charges&#160;&mdash; Cindy and John McCain jointly hold a credit card through Chase with a steep 25.99 percent interest rate. It had a top balance as large as $15,000 last year. </p>
<p>John McCain has his own credit card, his aide said, but its balance for years has not exceeded the $10,000 threshold that triggers the reporting requirement for listing liabilities on Senate or executive branch personal financial disclosure statements. </p>
<p>The last year John McCain reported holding a credit card with such a balance was 2004, when he had&#160; an American Express Platinum card with a top balance of $15,000. Cindy McCain also had a Platinum AmEx that year, with a top balance of $100,000, as well as a Business Platinum account with a top balance of $50,000, and charge cards from Saks Fifth Avenue, MasterCard and Visa with top monthly balances between $15,000 and $50,000 and interest rates between 10.49 and 24.49 percent. </p>
<p>And in 2004, one of their dependent children had an AmEx Business Platinum card with a top monthly balance of $50,000. The McCain aide wouldn&rsquo;t identify which child got the card, but their oldest, Meghan, turned 20 that year.</p>

Sarah Palin may be new to most Americans, but she&rsquo;s not entirely new to the national Democratic Party.</p>
<p>Democrat Tony Knowles, her opponent in the 2006 Alaska gubernatorial race, put together a<span id="more-75"></span> detailed, 63-page research document &mdash; obtained by Politico &mdash; cataloging Palin&rsquo;s strengths and weaknesses. And the Obama campaign, in particular, knows Palin well: A key Obama consultant, Anita Dunn, worked on Knowles&rsquo; campaign.</p>
<p>
&ldquo;We&rsquo;re running against John McCain &mdash; the issues raised around his decision and the fact that he clearly bowed under to the right wing of his party and let them exercise veto power over his vice presidential pick,&rdquo; Dunn said, suggesting the Obama campaign wouldn&rsquo;t be recycling the 2006 Democratic criticism of Palin.</p>
<p>
&ldquo;Whether it was Sarah Palin or Tim Pawlenty or Mitt Romney or somebody else, fundamentally that wasn&rsquo;t going to alter the dynamic &mdash; which is that John McCain believes we don&rsquo;t need to change the fundamental economic policies in this country,&rdquo; Dunn said.</p>
<p>
The Democratic opposition research document, which was not obtained from Dunn or from the Obama campaign, is largely a catalog of the day-to-day decisions of a small-town mayor. It contains examples of her sometimes confrontational tenure and colorful details of an ordinary woman who was thrilled to meet Ivana Trump and who began the process of opening a marketing company whose name &mdash; Rouge Cou &mdash; was supposed to be a French version of &ldquo;redneck.&rdquo;</p>
<p>
The document, largely a collection of newspaper clippings on local issues with no major revelations about Palin, details her socially conservative views &mdash; she opposes abortion even in the case of rape and incest, and supported an amendment to the Alaska Constitution to ban it &mdash; and also some of the exceptions to them. At one point, Palin supported mandatory education for teenagers about contraception, something that political insiders in both parties will find ironic in the wake of her 17-year-old daughter Bristol&rsquo;s pregnancy and upcoming marriage.</p>
<p>
Two overriding themes about Palin that emerge from the Democratic oppo research book are similar to the ones that have been heard since McCain announced Palin as his running mate on Friday &mdash; that she is too conservative and lacks experience.</p>
<p>
Palin also had a confrontational relationship with local media during her six-year tenure as Wasilla mayor.</p>
<p>
&ldquo;Palin is too socially conservative for Libertarian Alaska,&rdquo; reads one heading from the report. &ldquo;Palin&rsquo;s not ready for prime time,&rdquo; reads another.</p>
<p>
Palin, who scored an upset in the 2006 Republican gubernatorial primary by defeating Gov. Frank Murkowski, went on to beat Knowles 48 percent to 41 percent that November, despite a Democratic ad campaign that focused on her inexperience. Knowles had served as Alaska&#39;s governor from 1994 to 2002; earlier, he was mayor of Anchorage.</p>
<p>
Some of the details as stated in the 2006 Democratic research document:</p>
<p>
* Palin Is Too Socially Conservative for Libertarian Alaska. Palin is a strong conservative &mdash; something she repeated throughout her primary campaign but now seems to try to back off from. She is not only pro-life but is involved with &mdash; and even steered tax money toward &mdash; organizations that give misleading information on abortion. She called herself a &ldquo;hard-core fiscal conservative&rdquo; who wanted government to get to the bare bones. The Anchorage Daily News asked whether her &ldquo;socially conservative positions square with Alaska&#39;s generally libertarian approach to those issues.&rdquo; Palin also supported a flat tax, an idea even Bob Dole thought was absurd.</p>
<p>
* Palin&rsquo;s Management Style is to Bully and Demand Political Loyalty. Palin&rsquo;s tenure as mayor of Wasilla was marred by tremendous staff turnover, first when she fired most of the top staff &mdash; including the city&rsquo;s librarian &mdash; because she questioned their loyalty, and then later when staff quit because of her micromanaging style. Wasilla even lost the opportunity to hire a police chief because he said the job seemed too political.</p>
<p>
* Palin&rsquo;s Not Ready for Primetime. Palin argues that she was the mayor of the fastest growing city in Alaska. While that may be true, Wasilla&rsquo;s population is still 1 percent of the rest of the state of Alaska. The last budget Palin approved, $12.5 million, is 0.2 percent of the $7.3 billion budget Tony Knowles approved.</p>
<p>
* Palin Signed Ordinance to Issue $15 Million in General Obligation Bonds and Increase the Sales Tax From 2 to 2.5 percent. In 2001, Palin signed an ordinance authorizing the city to issue general obligation bonds in the principal amount of $14,700,000 to finance the acquisition and construction of park and recreation capital improvements. The ordinance also increased the sales tax from 2 to 2.5 percent and put the issue on the ballot. After it was adopted by voters, Palin signed an ordinance issuing the bonds. In 2002, Palin signed an ordinance putting the higher sales tax into effect. [Ordinance 01-55 (am),12/10/2001; Ordinance 02-14 (sub), 4/8/2002; Ordinance 02-49, 8/12/02]</p>
<p>* Palin Called Herself &ldquo;Such a Weasel&rdquo; for Not Having a Firm Stand on the Property Tax Cap.<br />
&ldquo;Does that mean she&rsquo;d vote for it? &lsquo;I still have five more weeks to make up my mind, like everybody&rsquo;s trying to do,&rsquo; Palin said. &lsquo;I wish it were not a statewide issue.&rsquo; Palin said she has declined requests by Tax Cap Yes to speak in favor of the initiative. Yet, she said, she doesn&rsquo;t object to her name&rsquo;s continuing to be listed on the group&rsquo;s Web site among 10 current or former government officials &mdash; half from Mat-Su &mdash; in support of the initiative. Palin acknowledged that she was sounding quite the politician. &lsquo;I am so sorry I&rsquo;m such a weasel,&rsquo; she said.&rdquo; [Anchorage Daily News, 10/8/00]</p>

* Palin Asked City Librarian About Censoring Books, Insisted It Was &lsquo;Rhetorical.&rsquo; In 1996, according to the Frontiersman, Wasilla&rsquo;s library director Mary Ellen Emmons said Palin asked her outright if she could live with censorship of library books. Emmons said, &ldquo;This is different than a normal book-selection procedure or a book-challenge policy. &hellip; She was asking me how I would deal with her saying a book can&rsquo;t be in the library.&rdquo; Palin said in response, &ldquo;Many issues were discussed, both rhetorical and realistic in nature.&rdquo; [Frontiersman, 12/18/96]</p>
<p>
* Wasilla&rsquo;s Pension Was Only Funded at 73 Percent When Palin Left, as Opposed to Almost Completely When She Became Mayor. In fiscal 2002, Wasilla funded 73 percent of its defined benefit pension plan obligation and had 52 percent unfunded liability as a percentage of its covered payroll. In fiscal 1995, Wasilla funded 97.5 percent of its obligation and had 4.3 percent unfunded liability as a percentage of payroll. <p>* Palin Supported Penalties for Using Skateboards on Public or Private Property in Wasilla.<br />
&ldquo;Beginning Oct. 15 &mdash; after the expected opening of the $233,000 Wasilla Skate Park &mdash; skaters will be breaking the law if they use their skateboards, in-line skates, bicycles, scooters (or any other recreational, non-motorized wheeled device) on public or private property where signs are posted forbidding their use.&rdquo;</p>
<p>The Frontiersman added, &ldquo;In the ordinance approved Monday, the penalty for first-time violators of the ordinance is a written warning and the skate device may be confiscated for 10 calendar days. For a second offense, a $50 fine shall be paid and the skate device may be confiscated for 30 calendar days. A third-time offender will have to pay a $100 fine and will lose his or her skate device permanently.&rdquo; [Frontiersman, 9/18/98]</p>
<p>* Palin Went to See Ivana Trump at Costco, Saying Alaska was So Desperate for &ldquo;Any Semblance of Glamour and Culture.&rdquo; &ldquo;Sarah Palin, a commercial fisherman from Wasilla, told her husband on Tuesday she was driving to Anchorage to shop at Costco. Instead, she headed straight for Ivana. And there, at J.C. Penney&rsquo;s cosmetic department, was Ivana, the former Mrs. Donald Trump, sitting at a table next to a photograph of herself. She wore a light-colored pantsuit and pink fingernail polish. Her blonde hair was coiffed in a bouffant French twist. &lsquo;We want to see Ivana,&rsquo; said Palin, who admittedly smells like salmon for a large part of the summer, &lsquo;because we are so desperate in Alaska for any semblance of glamour and culture.&rsquo;&#8221; [Anchorage Daily News, 4/3/96]</p>
<p>* Documents Show While Mayor Palin Had Thank You Notes to Campaign Donors Printed by Her Assistant on City Time and Arranged Campaign Travel from Her Office. &ldquo;The Voice of the Times, a separate editorial section within the opinion pages of the Daily News, made the original public records request that produced many of the documents that Murkowski&rsquo;s campaign handed out Thursday, including a stack of telephone records, e-mails &mdash; such as a campaign note from her mayor e-mail address to Ruedrich &mdash; and invoices from Wasilla City Hall. The documents appear to show, for example, that on one occasion Palin arranged campaign travel from the mayor&rsquo;s office. On another, her city administrative assistant printed thank-you notes to campaign donors. <p>* Palin Made a Bet With Her Husband About Whether Murkowski Would Get Into the Race &mdash; the Loser Had to Get a Tattoo. &ldquo;Palin told The Associated Press that she and her husband, Todd, made a bet on whether Murkowski would run. If the governor says he&rsquo;ll enter the race, Palin has to get the Big Dipper tattooed on her ankle. If Murkowski says no, Todd gets a wedding ring inked on his finger.&rdquo; [Anchorage Daily News, 5/26/06]</p>
<p>* Palin Obtained a Business License for Marketing and Consulting, Saying that She Wanted To Line Up Her Ducks if She Chose to Pursue It. &ldquo;Asked about the business registered under her name, Palin said, &lsquo;Rouge Cou, it&rsquo;s a classy way of saying redneck. It&rsquo;s a French word, rouge is red, cou is neck. It&rsquo;s for marketing and consulting, in case I wanted to go that route, I&rsquo;d have my ducks all lined up and have a business license. <hr /><b>What are the candidates hiding? &#8211; Yahoo! News</b>
<p>
In the past week, Cindy McCain released two pages of her 2007 tax return, and Joe Biden let reporters review &mdash; but not copy &mdash; 49 pages of his medical records.</p>
<p>
But those steps did not satisfy critics, reporters and opposition researchers, who pressed for McCain&rsquo;s tax schedules and the previous years&rsquo; returns for her and her husband, Republican presidential candidate John McCain. And they demanded the results of follow-up exams given to Biden, the Democratic vice presidential candidate, after his 1988 aneurysms. </p>
<p>
And those aren&rsquo;t the only hotly sought but unreleased records that could shed light on the candidates &mdash; and the families of those candidates &mdash; who are seeking to run the country. With less than two weeks to go until Election Day, each presidential campaign is accusing the other of withholding key documents that could answer outstanding questions about the personal and professional lives of the people at the top of the tickets, resulting in something of a transparency race subplot. </p>
<p>
So without further ado, here are 10 of the top missing documents from campaign 2008, in no particular order: </p>
<p>
&bull; Obama&rsquo;s legal clients</p>
<p>
Democratic presidential candidate Barack Obama has boasted of his time working as a civil rights lawyer in Chicago. But the boutique law firm that employed him for parts of 11 years &mdash; now known as Miner, Barnhill &#038; Galland &mdash; also handled matters that don&rsquo;t fit under the civil rights umbrella, including contracts, real estate deals, incorporations and civil defense.</p>
<p>
Obama, by some accounts, spent as much as 30 percent of his 3,700 billable hours on the last category.</p>
<p>
Neither his campaign nor the firm will release a list of the cases on which he worked.</p>
<p>Obama campaign spokesman Ben LaBolt asserted that &ldquo;Sens. Obama and Biden have taken voluntary transparency steps as legislators and candidates that have allowed their constituents, the media and their political opponents to fully examine both men.&rdquo;</p>
<p>
LaBolt pointed to lists of hundreds of the firm&rsquo;s clients that Obama attached to the mandatory personal financial disclosure statements he filed for each of his eight years in the Illinois state Senate.</p>
<p>
Included on the firm&rsquo;s client list was Rezmar, a development company co-owned by Obama&rsquo;s disgraced former fundraiser, Tony Rezko, as well as developer William Moorehead. Moorehead was convicted of stealing more than $1 million from public housing projects he managed and developments he co-owned with Obama&rsquo;s former boss, Allison S. Davis. Some of the thefts occurred while Moorehead was a client of the firm.</p>
<p>
Obama billed between five and seven hours to Rezmar-linked projects, including incorporating nonprofits connected to the company, according to the Chicago Tribune.</p>
<p>
Obama&rsquo;s campaign declined to answer when Politico asked if he did any work for Moorehead.&#160;</p>
<p>&bull; Palin&rsquo;s e-mails</p>
<p>
The electronic correspondence of Alaska governor and Republican vice presidential candidate Sarah Palin is in high demand, not the least because she used a private e-mail account to conduct state business in what some critics claim was an effort to circumvent the state&rsquo;s public record laws. </p>
<p>
Her husband, Todd, often was copied on e-mails about state business, and a state investigation found that she allowed her husband to use state resources to try to settle a family dispute, further fueling demands that she release her electronic mail. </p>
<p>
E-mails from her state account are subject to the state&rsquo;s public records laws &mdash; and a court ruling this month seemed to indicate e-mails from private accounts also could be subject to the laws. But that doesn&rsquo;t mean they&rsquo;re going to be easy, or inexpensive, to get. </p>
<p>
The state of Alaska is seeking to extend a deadline for producing the e-mails until Nov. 17 &mdash; nearly two weeks after the election &mdash; asserting that it is a laborious process to identify all of the relevant e-mails and have lawyers determine which parts can be released. </p>
<p>And since the state is refusing to waive its fees &mdash; including 10 cents for each printed page of e-mails, plus $960.31 for searching each state employee&rsquo;s account &mdash; the cost to each person requesting the documents could run into the thousands of dollars. </p>
<p>&bull; Biden&rsquo;s earmark requests</p>
<p>The McCain campaign has worked to make earmarks a major issue in the race, with McCain and Palin blasting Biden and Obama as free-spending earmarkers. </p>
<p>The two have pounced on Obama&rsquo;s earmark requests, which he voluntarily released going back to his first year in the Senate and which totaled $931 million. </p>
<p>Palin has had to explain her own earmark requests, which totaled $750 million during her two years as governor of Alaska. </p>
<p>And though McCain has boasted of never requesting &ldquo;a single earmark,&rdquo; he nonetheless has taken heat for seeking cash for home-state projects, albeit through more transparent legislative avenues. </p>
<p>That leaves Biden, a Delaware senator, as the only candidate in the quartet for whom there is no public record of earmark requests prior to fiscal year 2009. </p>
<p>Biden voluntarily released his earmark wish list for that year, and it comprises 116 projects with a total price tag of $342 million, including $34 million for the University of Delaware, which since 2002 has paid at least $1.5 million to a lobbying firm in which Biden&rsquo;s son Hunter Biden is a partner. The Obama campaign has said that Hunter Biden, who stopped his lobbying work last month, never lobbied his father. </p>
<p>&bull; John and Cindy McCain&rsquo;s taxes </p>
<p>After John McCain couldn&rsquo;t immediately recall in an interview how many houses he and Cindy owned, the couple&rsquo;s finances became an issue in the race, with Obama hammering McCain for being out of touch with regular folks&rsquo; economic concerns. </p>
<p>But beyond property records (which showed that Cindy McCain owns eight homes) and mandatory disclosure statements filed by John McCain (which showed that he owns relatively little, while Cindy and her children hold assets worth at least $24 million), McCain has been comparatively unforthcoming about his wealth. </p>
<p>McCain, who maintains separate finances from his wife, released his full tax returns for 2006 and 2007, while Cindy McCain, heiress to a beer distributorship fortune worth as much as $100 million, only released the first two pages of her returns for those years. </p>
<p>Biden and Palin also have released only two years worth of their tax returns, but their finances are substantially less robust than the McCains&#39;. In the years since it&rsquo;s become de rigueur for presidential candidates to release their tax returns, only Ronald Reagan in 1980 disclosed less tax information than McCain. </p>
<p>Obama, by contrast, has released his returns dating back to 2000.</p>
<p>
&bull; Obama&rsquo;s state Senate records and schedules</p>
<p>Obama&rsquo;s Senate files became an issue after he pressed Hillary Rodham Clinton during their nomination battle to release the schedules from her eight years as first lady. </p>
<p>When her campaign demanded Obama release his state Senate files, he told reporters he did not &ldquo;maintain a file of eight years of work in the state Senate because I didn&#39;t have the resources available to maintain those kinds of records.&rdquo; The records &ldquo;could have been thrown out. I haven&#39;t been in the state Senate now for quite some time,&#8221; he said. </p>
<p>His campaign later said that &#8220;files pertinent to ongoing casework&rdquo; were passed to his successor, but Obama didn&rsquo;t save correspondence with the general public, state associations or lobbyists, or memos on legislation and correspondence with Illinois state agencies. Some of the records that have surfaced have done little to dampen the demand for a more complete accounting. </p>
<p>For instance, Obama signed a pair of 1998 letters on his state Senate stationery urging state and Chicago officials to provide taxpayer support for a housing project headed by Davis, Obama&rsquo;s former law firm boss, and Rezko, who has since been convicted on federal corruption charges. </p>
<p>According to the Chicago Sun-Times, the pair reaped $855,000 in development fees from the $14.6 million project, which was entirely funded by city, state and federal tax dollars and was four blocks beyond the border of Obama&#39;s Senate district. </p>
<p>&bull; Palin&rsquo;s college transcripts </p>
<p>Palin attended five schools in three states before graduating from the University of Idaho in 1987 with an undergraduate degree in journalism. </p>
<p>A high school friend who attended three of those schools with Palin told the Los Angeles Times that the future governor got straight As, but a Palin spokeswoman declined to comment when asked by Politico if Palin would release her transcripts. The Times also reported that none of the 12 former Palin professors the newspaper interviewed remembered her. </p>
<p>&bull; Obama&rsquo;s Columbia thesis </p>
<p>Likewise, there&rsquo;s not a whole lot of information available about Obama&rsquo;s time at Columbia University in New York, which he attended for three years after attending Occidental College in Los Angeles for one year and from which he graduated in 1983. </p>
<p>His campaign would not release his transcripts, and it says it does not have a copy of his thesis, which dealt with Soviet nuclear disarmament and which has drawn intense interest.&#160;</p>
<p>UPDATE: LaBolt said that the nuclear disarmament paper wasn&rsquo;t a thesis, but rather a &ldquo;senior seminar paper,&rdquo; and that Columbia did not archive it.</p>
<p>&bull; All four candidates&rsquo; medical records</p>
<p>Biden, who had two brain surgeries in 1988 to repair separate aneurysms, is not the only candidate to be less-than-completely open when it comes to medical files. </p>
<p>McCain &mdash; who is 72 years old, has battled skin cancer and was tortured during five years as a prisoner of war in Vietnam &mdash; put his personal physician on a conference call with reporters to attest to his good health and granted selected journalists three hours to leaf through nearly 1,200 pages of records covering eight years. But the reporters were not allowed to photocopy or remove the documents, and they were prohibited from using cell phones or e-mail for expert assistance during the review.</p>
<p>McCain&rsquo;s steps didn&rsquo;t satisfy critics, including a group of nearly 3,000 doctors who demanded a &#8220;full, public release&#8221; of the candidate&rsquo;s records. </p>
<p>By comparison, Obama, who continues struggling to quit smoking and has a family history of cancer, has released only a one-page letter from his doctor proclaiming him in &#8220;excellent health,&#8221; as well as &#8220;lean and muscular with no excess body fat.&#8221;&#160;</p>
<p>Palin has yet to release her records, but seemed to express&#160;a willingness to do so in a Wednesday interview with NBC&rsquo;s Brian Williams.</p>
<p>
&bull; Obama&rsquo;s small donors</p>
<p>Obama boasted that half of the record-breaking $605 million his campaign raised through the end of September came from small donors. </p>
<p>But this summer, when a coalition of eight good-government groups asked both presidential candidates to voluntarily release information on small contributors, only McCain complied, posting a list of all his donors on his website. (Federal election rules only require campaigns to report the names, addresses and occupations of donors when they have given more than $200.) </p>
<p>Obama&rsquo;s small donors recently created headaches for his campaign, with news reports highlighting letters from the Federal Election Commission directing Obama to return contributions from people who exceeded the $4,600 individual limit by giving donations in under-$200 installments. Some were from previously undisclosed and apparently fictitious donors. </p>
<p>Obama said he returned the excess contributions; the FEC also asked McCain to return donations that exceeded the $4,600 individual limit. </p>
<p>&bull; McCain flight records </p>
<p>McCain&rsquo;s presidential campaign used a legal loophole to hopscotch the country in a jet owned by a Cindy McCain-controlled company, King Aviation, for cut-rate fares, according to The New York Times.&#160; </p>
<p>The paper reported that during a key five-month stretch when McCain was struggling to raise cash and gain traction in the battle for the Republican presidential nomination, the jet, a Cessna Citation Excel, was used almost exclusively for campaign purposes. The campaign reimbursed the company substantially less than it would have cost to charter a similar jet, the report said. </p>
<p>McCain&rsquo;s campaign continued paying King for use of the plane through the end of last month. FEC records show McCain&rsquo;s payments to the company total $477,000 since the summer of 2007. </p>
<p>But the campaign declined to release records detailing how much it paid for specific flights, which could permit calculations about whether the campaign was paying full charter rates. </p>
<p>From the beginning of 2007 through May 2008, King earned $303,000 for Cindy McCain and her dependent children, according to McCain&rsquo;s presidential disclosure form.</p>

<p>What Is A Federal Tax Lien</p>
<p>The Federal Tax Lien is a public document that confirms the claim of United States in the title, right and interest of the taxpayer&#8217;s assets. Where this document is kept depends on the law locally, either at the County clerk&#8217;s office or at the Secretary of State&#8217;s office.</p>
<p>The Federal Tax Lien is a negative mark on the credit report of a debtor. Many creditors ask for notes to check, once they know of this Federal Tax Lien (FTL.)</p>
<p>The Federal Tax Lien is considered to be the major claim against the assets of the debtor, excluding the first mortgage holders who have all their financing documents perfectly filed. The Federal Tax Lien may even shake the position of the factoring firms that lend on bank revolving lines of credit and on accounts receivable.</p>
<p>Local law in some jurisdictions allows separate filing of liens for personal property and any real property. In such cases, two identical liens are filed by the IRS, one under the real property records and the other under the personal property records. It is important to file both; otherwise it amounts to not perfecting the government claim on all assets. If we are talking about a corporation as the debtor, failure to file, depending on the local law, may result in imperfect claim. </p>
<p>The Federal Tax Lien is the main basis for the IRS for foreclosure of the assets of the debtor with seizure. Ever since the 1998 IRS Reform Act, these seizures have reduced. You should not mistake the lien with the IRS levy. The IRS has the power to levy on a debtor&#8217;s wages or accounts without a Federal Tax Lien. </p>
<p>People can also appeal the filing of a Federal Tax Lien if they have a good reason to do so. If you are able to confirm that the Federal Tax Lien will actually not help the government in recovering payments or that there is an incorrect tax assessment, you stand a chance to succeed.</p>
